Contractor Terms

Effective Date: October 18, 2025

Florida Pool Screens LLC (“FLPS,” “we,” or “us”) partners with licensed pool screen and enclosure professionals (“you” or “the contractor”) to connect them with local homeowners actively searching for pool screen repair, rescreening, and related services.

These Contractor Terms outline how our partnership program operates, how advertising funds are used, and what expectations apply to both parties. By joining our contractor network or purchasing any County Partner plan, you agree to the following terms.

1. Program Overview

The purpose of this program is to help Florida-based pool screen professionals grow their business through qualified, locally targeted homeowner inquiries generated via Google Ads and website placements on FLPoolScreens.com.

All homeowner inquiries are shared only with verified contractors who meet program eligibility and licensing requirements.

2. Program Structure & Fees

FLPS offers two participation levels: Shared County Partner and Exclusive County Partner.

Shared County Partner:

  • Shared with up to three contractors within a given county.

  • Monthly Access: $250–$500, depending on county size and population.

  • Google Ads Budget: $500–$1,000+ per month (set by FLPS campaign management).

Exclusive County Partner:

  • Exclusive rights to all homeowner leads within one selected county.

  • Monthly Access: $1,000+ per month.

  • Google Ads Budget: $500–$1,000+ per month (set by FLPS campaign management).

Both partnership levels include:

  • Transparent monthly reporting.

  • Tracking of lead flow, cost-per-lead, and performance metrics.

  • Dedicated ad management and optimization.

All Access fees and ad budgets are billed in advance on the first of each month. Fees are non-refundable once ad campaigns begin.

3. Strategic Growth Reserve (SGR)

Each month, FLPS reinvests 10% of total access fees into additional local ad spend to boost campaign performance for participating contractors.

These funds are pooled and used solely for ongoing testing, optimization, and lead generation within active service areas.

4. No Guarantee of Results

While FLPS works to deliver consistent homeowner inquiries, lead volume, cost-per-lead, and conversion rates vary based on market demand, competition, and contractor responsiveness.

FLPS cannot guarantee specific results, job bookings, or revenue outcomes.

5. Licensing, Insurance & Conduct

Contractors must:

  • Maintain active Florida state or county business licenses.

  • Maintain general liability insurance during participation.

  • Provide proof of both upon request.

  • Contact leads promptly and conduct business professionally.

Failure to maintain valid credentials, respond to homeowner inquiries, or uphold service quality may result in suspension or removal from the program.

6. Relationship of Parties

Participation in this program does not create an employment, joint-venture, or agency relationship. Contractors operate as independent businesses responsible for their own taxes, licenses, insurance, and service performance.

FLPS provides marketing and advertising services only and does not perform, warrant, or supervise any contractor work.

7. Payments & Billing

All Access and ad fees are due in full before campaigns begin.

Payments are processed securely through Stripe.

Failure to remit payment by the due date may result in suspension of campaign activity or termination of participation.

8. Data Privacy & Compliance

FLPS collects homeowner information solely for the purpose of matching users with local contractors. Contractors agree to:

  • Use homeowner data only for direct service-related communication.

  • Not resell, share, or store data beyond what is necessary to contact a lead.

  • Comply with the Telephone Consumer Protection Act (TCPA) and Florida Telephone Solicitation Act (FTSA)when contacting homeowners.

Violation of these data or communication policies may result in immediate termination and forfeiture of access.

9. Limitation of Liability

Florida Pool Screens LLC is not responsible for the performance, conduct, or outcomes of any contractor or homeowner. FLPS shall not be liable for any indirect, incidental, or consequential damages, including lost profits or business interruption, arising from participation in this program.

Contractors agree to hold FLPS harmless from any disputes or claims resulting from work performed for homeowners obtained through this platform.

10. Indemnification

Contractors agree to indemnify and hold harmless Florida Pool Screens LLC, its owners, affiliates, and representatives from any and all claims, damages, or liabilities arising from contractor actions, communications, or services rendered to homeowners.

11. Governing Law

These terms are governed by the laws of the State of Florida. Any disputes arising under or in connection with this agreement shall be resolved exclusively in Pinellas County, Florida.

12. Amendments

FLPS reserves the right to modify these Contractor Terms at any time. Updated terms will be posted at www.flpoolscreens.com/contractor-terms. Continued participation after such updates constitutes acceptance of the revised terms.

13. Termination

Either party may terminate participation at any time with written notice.

Active campaigns will continue until ad funds are exhausted.
